How Long Does It Take for a T Visa to be Approved and When Does the Work Permit Arrive?

The approval of a T Visa case generally takes between 2 and 3 years. Depending on the unique circumstances of each immigration case and USCIS’s workload when they receive the application, the final approval of a T Visa case could take longer. Fortunately, for humanitarian cases such as the T Visa, it is possible to obtain a work permit in approximately 8 to 10 months after USCIS receives the application.

General Timeline for the T Visa Process in 2026

  • Month 0: Filing of Form I-914.  
  • Months 1-6: Case receipt notice issued by USCIS.  
  • Months 1 to 6: Possible biometrics appointment.  
  • During the first year or later: Possible bona fide determination and work permit, if approved. 
  • Years 2 to 3: Full review and final decision.  

If the case requires additional reviews or receives a Request for Evidence, the final decision may take more than 3 years.   

These are not guaranteed processing times, but realistic estimates based on our experience with USCIS. Every case is different, and USCIS processing times vary. How Long Does It Take to Receive the Case Receipt Notice?

USCIS receives Form I-914 and issues the receipt notice (Form I-797C) in approximately 1 to 6 months. If the receipt notice does not arrive immediately, this does not necessarily mean there is a problem with the case.

How Long Does It Take to Receive a Biometrics Appointment Date in a T Visa Case?

Usually, between 1 and 6 months after receiving the application, USCIS may schedule an appointment at an Application Support Center (ASC) to collect fingerprints, photographs, and other biometric information. When USCIS needs biometric information, it sends a notice with the date, time, and location of the appointment. Although there is no specific timeframe for receiving the notice, we provide an estimate based on our experience with T Visa cases.

How Long Does It Take to Receive a Work Permit Through the T Visa?

Certain applicants may receive a work permit within 8 to 10 months, even while their case is still pending. After conducting an initial review of the application and the applicant’s background, USCIS may determine that the application is bona fide and that deferred action should be granted. This process applies to certain cases filed on or after August 28, 2024, and is known as the Bona Fide Determination. It allows USCIS to issue a work permit and provide temporary protection before making a final decision on the T Visa case. Although the work permit is often received during the first year, it could also take longer depending on the case and USCIS’s workload.  A work permit could provide benefits and opportunities such as: 
  • A Social Security number 
  • Financial independence 
  • Better job opportunities and working conditions 
  • Partial protection from detention 
  • Access to public benefits

How Long Does Final Approval of a T Visa Case Take?

The entire process can take approximately 2 to 3 years from filing to the final decision, although some cases may be resolved sooner or take longer. A bona fide determination and work permit do not mean that the T Visa has already been approved or that it will be approved: USCIS continues reviewing the case after these stages, and the results are not guaranteed. Why May T Visa Cases be Delayed?

A Request for Evidence (RFE), pending background checks, issues with biometrics, or the need for additional review could delay the T Visa process. For these reasons, a case that initially appeared likely to be resolved within the approximate 2-to-3-year timeframe could extend beyond 3 years.
